General terms of use

The General Terms and Conditions of Use apply to any visit to or use of the Platform by a user (hereinafter referred to as the 'User') and to products and services offered by Kristel Van Espen in the context of rollerdance.be, rollerjoy.be.

By visiting or using the platform, the User acknowledges having read the General Terms and Conditions of Use and accepts the rights and conditions stated therein.

By exception, other Terms and Conditions of Use can be agreed only by written agreement. Such exceptions may consist in the amendment, addition or deletion of the terms to which they relate and do not affect the application of the other  General Terms and Conditions of Use.

We have the right to change our Terms and Conditions of Use at any time without notice. We commit to apply the Terms and Conditions that are applicable at the time the User used the Platform.

 

 

Platform

Accessibility and navigation

We take all reasonable and necessary measures to ensure the proper functioning, security and accessibility of the Platform. However, we cannot provide an absolute guarantee of performance and our actions must therefore be regarded as being covered by an obligation of means.

Any use of the Platform or channel where a product or service is offered by Kristel Van Espen in the context of rollerdance.be, rollerjoy.be is always at the User's own risk. We are therefore not liable for damage that may be the result of any malfunctions, interruptions, defects or harmful elements. This list is not exhaustive.

We reserve the right to interrupt access to the Platform or its operation at any time, without notice.

 

Content

Kristel Van Espen determines the content of the Platform and takes great care of the information on it. We take all possible measures to keep the Platform as complete, accurate and up-to-date as possible, even when the information is provided by third parties. We reserve the right to change, add or remove the Platform and its content at any time, without any liability.

We cannot offer an absolute guarantee with regard to the quality of the information on the Platform. As a result, this information may not always be complete, accurate, sufficiently accurate or current. Consequently, we cannot be held liable for any damage, direct or indirect, that the User may suffer as a result of the information provided on the Platform or other channel used by us in the context of promoting the products or services for rollerdance.be.

If certain content of the Platform violates the law or the rights of third parties, we request each User to notify us by e-mail as soon as possible so that we can take appropriate measures.

Any download from the Platform is always at the User's own risk. We are not liable for damage, direct or indirect, resulting from such downloads, such as loss of data or damage to the computer system of the User, which are the sole and exclusive responsibility of the User.

 

Links to other websites

The Platform may contain links or hyperlinks to external websites. Such links do not automatically imply that there is a relationship between Rollerdance.be, rollerjoy.be and the external website or even that there is an implicit agreement with the content of these external websites.  We have no control over such external third party websites.  We are therefore not responsible for the safe and correct functioning of the hyperlinks and their final destination. We cannot be held liable for further damage.

 

 

Intellectual property

The structure of the Platform, as well as the content, texts, graphics, images, photos, sounds, videos, etc… of which the Platform is composed or which are accessible through the Platform, are the property of Kristel Van Espen or Kristel Van Espen has the necessary rights, and as such are protected by intellectual property law.

Any representation, reproduction, adaptation or partial or full exploitation of the content, brands and services offered by the Platform, in any way whatsoever, without the prior, express and written consent of Kristel Van Espen, is strictly prohibited, with the exception of elements that expressly designated as 'royalty-free' on the Platform.

The User of the Platform is given a right to access, use and display the Platform and its content. This right is granted on a non-exclusive, non-transferable basis and may only be used for personal and non-commercial purposes. Unless otherwise agreed in writing in advance, the User is not permitted to modify, reproduce, translate, distribute, sell or communicate to the public, in whole or in part, the protective elements.

The User is prohibited from entering data on the Platform that would change or may change the content or appearance of the Platform.

 

 

Applicable law

 

These General Terms and Conditions of Use are governed by Belgian law.

In case of a dispute and in the absence of an amicable solution between the parties, the dispute will be submitted to the courts of the judicial district where Kristel Van Espen has its registered office.

 

Other Terms and Conditions

Kristel Van Espen reserves the right to change, expand, remove, limit or interrupt the Platform and the associated services and products at any time, without prior notice and without liability.

In case of a violation of the General Terms and Conditions of Use by the User, we reserve the right to take appropriate sanctions and compensation measures. We reserve the right to temporarily or permanently deny the User access to the Platform or services. These measures may be taken without reason and without notice. They cannot entail the liability of Kristel Van Espen, nor can they give rise to any form of compensation.

The illegality, full or partial invalidity of our General Terms of Use shall not affect the validity and application of the other Terms and Conditions. In such case, we have the right to replace the Terms and Conditions with another valid provision serving the same purpose.

 

 

General Terms and conditions of sales

 

These General Terms and Conditions of Sale define the mutual rights and obligations in case of the purchase of products or services by a User (who, in the case of the General Terms and Conditions of Sale, is hereinafter referred to as “Customer” and/or “Participant”).

The General Terms and Conditions of Sale express all obligations of the parties. The Customer is deemed to accept them without reservation, failing which his order will not be validated.

Exceptions to the General Terms and Conditions of Sale can be made in exceptional cases, provided that these exceptions have been agreed in writing. Such deviations may consist in amending, adding or deleting the Terms and Conditions to which they relate and do not affect the application of the other General Terms and Conditions of Sale.

We reserve the right to change the General Terms and Conditions of Sale. The changes will take effect as soon as they are published online for any purchase after that date.

The General Terms and Conditions of Sale apply to all services (and/or products) offered by Kristel Van Espen, creator and owner of the rollerdance.be, rollerjoy.be concept, also known as 'Seller' and/or 'Organizer'. More specifically, it concerns events or activities"Rollerdance The Party" and "Rollerdance In the City", "Rollerdance Bachelorette", "Rollerdance teambuildings", "Shows and acts", or other future services that may be offered.

 

Ticket sales & payments

For the sale of tickets, we use the ticketing system 'Eventbrite' and/or Wix Events, where the Customer follows the ordering process in order to register for a rollerdance.be, rollerjoy.be event or activity of his/her choice. The sale is concluded when the Customer has completed all steps of the ordering process, has completed it and after receipt of payment. By validating his payment, the Customer accepts the General Terms and Conditions of Sale.

The Customer makes the payment at the time of the final validation of the order using the payment methods offered via Eventbrite, Wix.com, Mollie.com or other secure payment services. This validation is valid as a signature.

The Customer guarantees the Seller that he has the necessary authorizations to use the chosen payment method and acknowledges that the information provided for this purpose constitutes proof of his agreement to the sale and the payment of the amounts due under the order.

The Seller reserves the right to block the Customer's order in case of refusal of authorization to pay by credit card by accredited organizations, non-payment or any other problem on the part of the Customer until the problem has been resolved.


Tickets are non-refundable and non-exchangeable, unless otherwise agreed in writing with the organizer.

 

Rental of roller skates and protection equipment

When purchasing a ticket for participation in an event or class, the organizer may offer the possibility to rent roller skates and protective equipment. However, the organizer is not obliged to do so, but will check event by event whether it is able to offer this service to the Customer.

In case this option is offered, this will be added as an extra option when the tickets are sold, whereby the Customer has the choice whether or not to opt for this option, subject to payment of the cost associated with the rental of the equipment.


For the rental of the equipment, we work with an external third party.

If the Customer has chosen to rent roller skates and/or protective equipment when ordering his/her ticket, this material will be made available at the event or class.

All rented equipment must be returned after the event, in any case before 'The Customer' leaves the event. If the Customer does not return the material, a fine will be charged equal to the new price of the type of material that has been lost of the same brand and quality or a similar brand of the same quality. In addition, the administrative and logistical costs associated with the purchase of this material will be charged to the Customer.

 

Price


The price for participation in an event or class is indicated at the ticket sale.

Prices are indicated in euros and may vary from event to event and type of ticket. The total amount of the order is stated for the final validation of the order.

The seller reserves the right to change its prices at any time by publishing them online. Only the prices indicated at the time of the order apply, subject to availability on that date.

 

Confirmation


After completing the purchase, the Customer will receive a confirmation at the email address provided by him/her.

 

Delivery 


The delivery of the service takes place at the time of the event or class for which the Client has registered, except in case of force majeure or cancellation. See the section 'Cancellation' and 'Force Majeure'.

 

Right of withdrawal

 

The right of withdrawal does not apply to enrollments for events or classes. Nor can any refund be claimed by the Customer.

 

 

Information about the events/classes


The program of events and activities are described and presented with the greatest possible accuracy. However, in the event of errors or omissions in the presentation, the Seller cannot be held liable for this.

 

Safety & liability

Due to the nature of the activity: roller skating and dancing on roller skates, the use of protective equipment is strongly recommended. It is The Customer's responsibility to use protective equipment. We cannot be held responsible for any accidents and/or injuries.

We take the necessary measures to ensure that the event or activity takes place as safely as possible and we make every effort to comply with the necessary safety regulations that apply at that time. This does not alter the fact that the Customer also bears a responsibility and must comply with the rules. If the Customer / Participant does not comply with the rules that apply at that time, the Organizer has the right to deny the participant further access to the event.

Services on demand

 

For the sale of services on demand such as private workshops, team buildings, shows & acts or other services that are offered without tickets, the agreement is concluded when the Customer approves the offer/proposal sent to him/her. Specific terms and conditions associated with the service are included in the offer/proposal and are an addition to the General terms and conditions. The general payment term for custom services is 10 working days after delivery of the service. In the event of non-compliance with the payment term, a late payment interest of 10% of the invoice amount will be charged. Specific conditions may include an advance payment, delivery of the service, different payment terms and other conditions with regard to the service. Specific terms and conditions always take precedence over the General terms and conditions. For services on demand, Rollerdance.be, rollerjoy.be can work with third parties to perform the service and/or provide the location.

 

Images

Photos may be taken during the event or class by the organizer, a photographer or other person appointed by the Promoter. The Participant/Customer agrees that photos will be taken that can be used for marketing and promotional purposes via rollerdance.be, rollerjoy.be and its marketing channels.

The Participant/Customer has the right to have a photo removed on which he or she is recognizable. In this case, the Participant/Customer will contact the Organizer via kristel@rollerdance.be with a request to remove the photo and the notification about which photo it is exactly, after which the Organizer will remove the photo. After removal of the photo, The Participant/Customer will receive a confirmation of removal by e-mail.

 

Special conditions regarding crisis situations

The organizer ensures that the safety regulations applicable at the time the event or classes take place are met and that they are complied with.

The Participant/Customer declares that he/she will comply with the applicable rules. If the Participant/Customer does not comply with the rules, the Organizer has the right to deny the Participant/Customer further access to the event.

The Participant/Customer declares that he/she meets the conditions imposed by the government and applicable at that time to participate in an event. The Organizer can in no way be held responsible for any contamination and/or the result of a Participant/Customer.

 

Data protection

 

The Seller guarantees its Customer the protection of its personal data in accordance with the Privacy Policy available on the Platform.

 

 

Cancellation

In case of cancellation of an event or activity by the Organiser, the ticket will remain valid for an event or activity on a different date and/or time. In this case, the organizer will contact the Client/Participant. If no new event or activity is organized, the ticket will be refunded with the exception of the service costs charged by the payment system, unless otherwise agreed in writing with the Organiser. For events, activities or services offered by third parties via the Platform, the General Terms and Conditions of this third party apply. In the event of cancellation of a customized service due to illness or force majeure, for example, a new date will be agreed/determined with the Customer.

 

In case of cancellation of a customized service after approval by the Customer without a valid reason of illness or force majeure, the full (agreed) amount remains due. In case the Customer/Participant cancels for an event or activity or does not show up, no refund is possible, unless otherwise agreed in writing with the Organiser. In case of no shows for a customized service or cancellation after approval of a quote, the full amount remains due.

Force majeure

If the Seller / Organizer is wholly or partially prevented from executing the order / the events or classes due to an unforeseen circumstance beyond his control, then there is force majeure.

 

In case of force majeure, the Seller / Organizer has the right to suspend the execution of the order in whole or in part for the duration of the force majeure. The Seller will immediately inform the Customer thereof.


If the force majeure continues for more than 90 days without interruption, the ticket will be refunded with the exception of the service costs charged by the payment system, unless otherwise agreed in writing with the Organizer.  For events, activities or services offered by third parties via the Platform, the General Terms and Conditions of this third party apply.

 

Independence of Conditions

If one or more of these General Terms and Conditions of Sale is declared illegal or invalid, the remaining Terms and Conditions will be applicable.


The Seller reserves the right to replace the illegal or invalid provision with another valid provision with the same purpose.


Applicable law and court


These General Terms and Conditions of Sale are governed by Belgian law.

In case of a dispute and in the absence of an amicable solution, the dispute will be submitted to the courts of the judicial district of the Seller's registered office.
